Terms of Service & Privacy Policy

1 What We Do

XLeads is a lead generation service that connects pre-qualified consumers with licensed financial advisors in New Zealand. We generate insurance and mortgage leads through digital marketing and comprehensive qualification quizzes, then distribute these leads to our approved advisor network.

2 Definitions

  • "We", "Us", "Our", "XLeads" – XLeads (xleads.co.nz)
  • "Advisor", "You" – A licensed financial advisor, mortgage broker, or insurance professional who purchases leads from XLeads
  • "Consumer", "Lead", "Client" – An individual who has completed our qualification quiz and consented to being contacted by an advisor
  • "Personal Information" – Any information that can identify an individual, including name, email, phone number, and financial situation details

3 Licensing Requirements

All advisors purchasing leads from XLeads must hold a valid New Zealand Certificate in Financial Services (Level 5) in the appropriate discipline.

  • Insurance leads: NZ Certificate in Financial Services (Level 5) – Life, Disability and Health Insurance strand
  • Mortgage leads: NZ Certificate in Financial Services (Level 5) – Residential Property Lending strand

By purchasing leads from XLeads, you confirm that you hold the appropriate license and are operating as a Financial Advice Provider (FAP) or under a FAP in compliance with the Financial Markets Conduct Act 2013.

4 Legal Obligations & Liability

All legal obligations between you (the advisor) and the consumer are solely your responsibility.

XLeads acts only as a lead generation and distribution service. We are not a party to any agreement, advice, or transaction between you and the consumer.

  • XLeads holds no responsibility for the advice you provide to consumers
  • XLeads holds no responsibility for any financial outcomes or decisions made by consumers
  • XLeads holds no responsibility for disputes, complaints, or claims arising from your engagement with consumers
  • XLeads holds no responsibility for regulatory compliance or professional conduct obligations

You are solely responsible for complying with all applicable laws, regulations, and professional standards including but not limited to the Financial Markets Conduct Act 2013, the Privacy Act 2020, and any requirements of your licensing body.

5 Lead Quality & Refunds

We strive to deliver high-quality, pre-qualified leads. However, we cannot guarantee:

  • That any lead will result in a successful sale or engagement
  • The accuracy of information provided by consumers
  • That consumers will be contactable or responsive

Refund policies are determined on a case-by-case basis and are at our sole discretion. Valid lead complaints must be submitted within 7 days of lead delivery.

6 Data We Collect

From Consumers:

  • Full name
  • Email address
  • Phone number
  • Region
  • Financial situation details
  • Insurance/mortgage preferences

From Advisors:

  • Business name and details
  • Contact information
  • FSP number
  • Lead preferences

7 Consumer Consent

All consumers who complete our quizzes explicitly consent to:

  • The collection of their personal information
  • The transfer of that information to licensed financial advisors
  • Being contacted by phone, SMS, or email by a financial advisor

8 Your Obligations as an Advisor

By purchasing leads from XLeads, you agree to:

  • Contact leads promptly (within 24 hours recommended)
  • Provide professional, compliant advice
  • Handle consumer data in accordance with the Privacy Act 2020
  • Maintain appropriate professional indemnity insurance
  • Not resell or redistribute leads to third parties
  • Notify us of any licensing status changes

9 Third-Party Tools

We use trusted third-party services such as Google Analytics, Meta Ads, Supabase, and Resend. These services may collect anonymised usage data via cookies or tracking pixels. We are not responsible for the privacy practices of these platforms.

10 Data Security

Data is stored using encrypted cloud platforms with commercially reasonable safeguards. While we implement appropriate security measures, no system is perfectly secure. We cannot guarantee absolute security of data transmission or storage.

11 Limitation of Liability

To the maximum extent permitted by law:

  • XLeads shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount paid for leads in the 3 months preceding the claim
  • We make no warranties, express or implied, regarding lead quality or conversion rates

12 Termination

We reserve the right to suspend or terminate your access to our service at any time, with or without cause, including but not limited to: loss of licensing, regulatory action, breach of these terms, or conduct that damages our reputation or consumer trust.

13 Governing Law

These terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand, and you consent to their exclusive jurisdiction.

14 Changes to Terms

We may update these Terms and Privacy Policy from time to time. Continued use of our services after changes constitutes acceptance of the updated terms.
